Over past decades nobody of law within the civil justice system has experienced greater ferment than the law of torts. Particularly, the law relating to negligence and strict liability, as it is an “everyday accident” that courts address. In agreement with received jurisprudential wisdom, the authors maintain that there is no grand theory that will satisfactorily differentiate or explain the dynamic interactions of change between tort law, negligence and the law relating to strict liability.
