Contract law is the foundation of all commercial law. It is a subject that law students meet in their first year of study. This book is intended as an introduction to the law that governs contracts in Kenya. While the common law of England continues to play an important role, there is a rich jurisprudence and an array of Kenyan cases that have significantly contributed to the law, a number of which have been discussed. This book is largely aimed at undergraduate students of law; as such, it takes a more descriptive, rather than a critical approach explaining the law as it is, though practitioners and lecturers of law will also find it useful. There have also been some changes in legislation that will undoubtedly have an impact or encroach on contract. The most significant in this regard is perhaps the Consumer Protection Act, 2012, in so far as consumer transactions are concerned.
